Terms & Conditions of Sale - Order Verification

ORDER VERIFICATION 

Thank you for your purchase! Here at Monster Transmission LLC (“MTP” or “Monster Transmission”), we care about getting your order right the first time. Please carefully review your invoice and order details as soon as possible. 

MTP’s Account Managers will do their best to communicate with you and ensure your purchase will be a delightful experience. Importantly, the final decision on the specifics of your order, such as vehicle application, input/output shaft lengths, splines, engine specs, adapters, etc., are ultimately your call. MTP will not be liable for labor, shipping costs, or other incidental charges related to an incorrectly ordered product(s). 

Your signed order verification represents your complete acceptance of these Terms and Conditions of Sale (“Terms”), in full, and is a required step.. These Terms shall apply to any purchase or procurement of products or services by you from MTP. We encourage you to read these Terms and ask MTP any questions you may have. Any variation from these Terms requires the signed written consent of an authorized MTP representative. 

These Terms: (i) replace and supersede any previous terms; (ii) supersede any prior or contemporaneous agreements or correspondence between you and MTP; and (iii) supplement the terms and conditions found on your order verification and invoice. To the extent of any conflicts between these Terms and your invoice, the invoice shall control. 

RECEIVING & INSPECTING YOUR ORDER 

Please inspect the packaging when receiving your Monster Transmission product(s). Shipments are insured, therefore, claims for damage must be made with the freight company. Never sign for a damaged product without notating the shipping paperwork. Do not return the merchandise to MTP unless prior arrangements have been made with MTP. Products returned without prior authorization from MTP will be refused and returned at your expense. Review the contents of your order upon receipt. You must contact MTP within seven calendar days of delivery to report any missing or incorrect items. Claims regarding missing items or refunds are forfeited upon the eighth day. 

ACTIVATING YOUR WARRANTY & CORE POLICY 

***Once Core/Core Fee (In the event No Core was charged) has been received by MTP, your Warranty becomes active with the start date being the invoiced ship date***

All Warranties are contingent upon core/pod returns and/or fees. If the core/pod is not returned within thirty calendar days or a core/pod fee is not paid in full within thirty calendar days of delivery, the Warranty becomes null and void. All core/pod returns must be scheduled and authorized by MTP’s Core Department prior to return to MTP. If a core/pod deposit was taken on your order, the deposit refund will be issued back to the original purchaser either via check, credit card or store credit, minus any shipping and handling fees.  

All transmission, engines and transfer case cores returned for credit or warranty activation must be the exact replacement of the transmission purchased. The core must be complete, intact/assembled, in rebuildable condition, and accompanied by the torque converter. Returned cores that are damaged in transit or missing components and/or the torque converter will require payment by you of the core/pod fee to activate the Warranty.  

You further agree to allow MTP to charge your credit card all costs associated with the collection of the core/pod. If you do not cooperate with the billing of the core/pod owed, MTP reserves the right to send you collections to collect such costs.  

If you have elected to OPT-OUT of the Warranty by choosing not to return a core/pod or pay a core/pod fee, you shall forfeit all Warranty coverage, service and support, and will be deemed to have made an “AS-IS” purchase. If you selected the Core Return Service or paid Core Return Shipping but do not return your core/pod within the time frame specified above, you will owe the difference in the actual Core/Pod Value.  

BREAK-IN PERIOD 

All Transmissions have a break-in period of 500 miles. Driving during this time should be “light”, meaning no excessive use or abuse, long road trips, racing, off roading, towing, etc. Fluid level should be checked frequently. It is also recommended that all transmissions be installed within 90 days of delivery. Transmissions are drained of fluid after testing in order to meet freight requirements. Failure to install the transmission within the recommended time frame may affect your warranty as steel components may rust. 

TERMS OF THE WARRANTY 

Transmissions supplied from MTP are deemed to be quality inspected. MTP’s Warranty is extended only to the original purchaser and is non-transferable and non-assignable. Any other products offered by MTP are sold “AS-IS” unless they come with their own specified manufacturer Warranty. 'Extended' or 'Doubled' Warranty coverage will follow the same guidelines, terms and conditions as MTP's Warranty coverage, as described herein. 'Extended' or 'Doubled' Warranty coverage does not include or extend White Glove Premium Warranty upgrade.

“Extend” Product Warranty coverage is a third-party Warranty Service. If you purchase this add-on, you are eligible for an extended warranty as an extension of the MTP warranty period. Once the MTP warranty has elapsed and you are in the “Extend” warranty period, should you have an issue, please go to https://customers.extend.com/en-US/authentication  to transact on your extended warranty.

The MTP Warranty duration is dependent on the level of your build/purchase and will be listed on the invoice. Once MTP’s Warranty Department authorizes a repair, MTP will determine a course of action that may include repair at an authorized facility or return to MTP for repair or replacement. If the unit is to be repaired, labor will be paid at $75 per hour based on ALLDATA OE flat rate schedule. A labor warranty must be approved in writing by an MTP warranty representative prior to performing any work. Warranty labor reimbursement will not be paid until an approved invoice is received and can take up to 30 days from receipt to be paid out. If a 3rd party performs an internal repair on the MTP product, they now assume full responsibility for the product, and you release MTP from any liability or coverage. 

MTP’s Warranty DOES NOT cover any of the following: 

  • Freight damage claims. 
  • Rental cars, loss of wages or income, and any labor costs not associated with a previous agreement made by MTP. 
  • Towing costs, and any other incidental costs or damages that may be associated with product failure or non-performance. 
  • Any product that has been physically altered, improperly installed or maintained. 
  • Any product used in an improper application, abused or not used in connection with proper parts. 
  • Any product that is defective due to accident, neglect or unauthorized repair. 
  • Any product where proper cooling and or fluid levels have not been maintained. 
  • Failure to replace the cooler and/or not flushing the system properly. 
  • Freight or labor costs on a denied warranty claim.

There are no Warranties that extend beyond the description on the face of this document. 

WARRANTY WILL BE VOIDED IF THE FOLLOWING REQUIREMENTS ARE NOT MET:

  • The transmission cooling system must be flushed with a fluid flush mechanical pump system that flushes the cooler and lines (such as Transflo Oil Cooler Flush machine). Canned/Air flush systems are not acceptable. If you cannot flush your cooler system, you will need to purchase a new transmission cooler system.   • High-performance and towing applications require the installation of an auxiliary transmission oil cooler. 
  • TV Cable (when present) must be adjusted properly to ensure the transmission's adequate function.
  • Incorrect applications (ie Horsepower Limits Ignored)
  • Any and all repairs or tampering made to a product by you or an agent acting on your behalf without prior written authorization by an MTP Warranty representative will result in loss of Warranty. The Warranty becomes null and void once any transmission is installed in conjunction with a used torque converter. MTP reserves the right to deny Warranty coverage if the issue is determined not to be manufacturer related.

MTP recommends that all transmissions and torque converters are installed by an ASE/ATRA certified transmission shop to obtain optimal performance. These are highly complex drivetrain components, and failure to have a unit professionally installed may result in unnecessary issues and a potential loss of Warranty. 

What Does an Approved Warranty Cover?

Our Warranty is not just about protecting your investment; it is about providing comprehensive coverage to ease your mind. 

Here is what sets MTP apart: 

  • Shipping Costs: We understand that unexpected shipping expenses can add up quickly, but with Monster Transmission's Warranty, we will cover shipping the transmission to MTP for a free diagnosis. If approved, return shipping will also be covered.
  • RE & RE Labor Time: We understand that time is money. That is why we will cover 1 hour of diagnostic time and RE+RE labor time according to ALLDATA OE Flat Rate times for all approved warranty claims at a labor rate of $75/hr for the first year.
  • Fluid: In many cases, the fluid can be reused, in the event the fluid cannot be reused, MTP will cover the rated volume of ATF fluid cost at $11/quart, for the first year.
  • Repair of the Transmission: MTP will ensure the transmission is repaired to MTP original specifications.

ADDITIONAL WARRANTY NOTES:

All repairs must be completed at a professional, certified shop using the appropriate scan tools, cooler flush machines, and repair equipment. An invoice must be submitted before any warranty claim will be reviewed. Compensation will only be reimbursed to the original purchaser.

Your Warranty and these Terms are subject to the laws of Florida. Any action brought or held based on the Limited Warranty and/or Terms & Conditions of Sale Agreement will be brought and held in the courts located in Palm Beach County, Florida. 

TRANSMISSION WARRANTY PERIOD AND COVERAGE

If all Warranty conditions have been met to activate the Warranty on your purchase (i.e., core returned, core fee paid, torque converter purchased , and no balance owed on the account): Warranty time frames are as follows, unless expressed differently in writing on the purchase invoice:  

Product Codes: Merch and GGL  

  • Transmission: Stage 1; and/or Bare Bones - 6 months, unlimited miles from date of shipping  
  • Transmission: Stage 2; and/or Heavy Duty; and/or 550 HP or below - 1 Year, unlimited miles from date of shipping  
  • Transmission: Stage 3; and/or Super Duty; and/or Super Sport; and/or High Performance; and/or 750 HP or below Merch- 90 Days, unlimited miles from date of shipping  
  • Transmission: Stage 4; and/or SSX; and/or 1000+ HP Merch – 30 days, unlimited miles from date of shipping  

Product Codes: Non-Merch and GGL  

  • Transmission: Stage 2, Heavy Duty, Mild Remanufactured, Mega Monster, or 550 HP or below 3 Years, unlimited miles, from date of shipping,  
  • Transmission: Stage 3; and/or Super Duty; and/or Super Sport; and/or High Performance; and/or 750 HP or below90 Days, unlimited miles from date of shipping  
  • Transmission: Stage 4; and/or SSX; and/or 1000+ HP– 30 days, unlimited miles from date of shipping 

Monster Series Coverage

TRANSACTING ON A WARRANTY CLAIM

If a failure occurs within the warranty period, you have two options:

  1. Return the transmission to MTP for inspection. In which MTP will cover the shipping costs to Monster for a free diagnosis. You will be responsible for the return shipping costs if the warranty claim is denied along with any repair charges.

or

  1. Request an expedited replacement transmission with a security deposit of 50% of the original purchase price (excluding core charge). The deposit will be refunded upon receipt and inspection of the failed unit. If your warranty is denied (see the section describing reasons for denied warranty claims), the deposit will be forfeited. If the warranty is approved, the full deposit amount, including freight and labor charges, will be credited in accordance with the policy. 

RETURNS, REFUNDS, AND STORE CREDIT

Customers may return unused, unopened, non-damaged products within 30 days of delivery, subject to MTP agent approval and a 25% restocking fee. Return shipping costs are your responsibility.

Custom-built Transmissions, Custom Torque Converters, Track Monster Transmissions, Engines, Transfer Cases, and Powertrain packages are non-returnable. Orders canceled before shipping are subject up to a 50% cancellation fee based on MTP's incurred costs.

THE WARRANTIES COVERAGES DETAILED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES, CONDITIONS, REPRESENTATIONS AND GUARANTEES (EXCEPT WARRANTIES OF TITLE), INCLUDING, BUT NOT LIMITED, TO IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE. 

LIMITATION OF LIABILITY

IN NO EVENT WILL MONSTER TRANSMISSION BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR INDIRECT DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS OR REVENUES OR USE EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. MONSTER TRANSMISSION’S LIABILITY FOR DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS SHALL IN NO EVENT EXCEED THE INVOICE PRICE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THESE LIMITATIONS AND EXCLUSIONS WILL APPLY REGARDLESS OF WHETHER LIABILITY ARISES FROM BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), BY OPERATION OF LAW, OR OTHERWISE. THESE EXCLUSIONS OF DAMAGES SHALL BE DEEMED INDEPENDENT OF, AND SHALL SURVIVE, ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY UNDER THESE TERMS.

INDEMNIFICATION

You agree to defend, indemnify and hold Monster, its officers, directors, members, employees, affiliates, agents and assigns harmless from and against any and all claims, suits, damage, losses, liability, cost or expense (including, without limitation, reasonable attorneys’ fees and expenses) related to or arising from your (or your agents, affiliates, or assigns) improper use of any products purchased, the combination or use of the products with other products, misuse of the products, or acts or inactions hereunder or any breach of these Terms. This section shall survive the termination or cancellation of the Terms or any invoice. 

FORCE MAJEURE

Monster Transmission shall not be liable for delays in performance caused by or resulting from acts beyond Monster Transmission’s reasonable control, including, without limitation, acts of God, flood, pandemic, quarantines, fire, earthquake, explosion, war, invasion, hostilities, terrorist threats or acts, riots, civil unrest, government order or law, embargoes or blockades, national or regional emergency, strikes, labor stoppages or slowdowns or other industrial disturbances (a “Force Majeure”); however, Monster will advise you within a reasonable period as to the occurrence of the Force Majeure and the period of time it is expected to impact its performance.

MISCELLANEOUS

These Terms are subject to the laws of the state of Florida, without giving effect to any conflict of law provision. The United Nations Convention on Contracts for the International Sale of Goods, 1980, and any successor thereto, shall not apply to these Terms. In the event of a dispute between you and MTP related to or arising out of these Terms or otherwise, you agree that any litigation will be brought and held in the courts located in Palm Beach County, Florida. The prevailing party in such litigation is entitled to recover from the losing party all reasonable costs incurred, including any attorney’s fees and costs, court fees, appraisals and expert witnesses, whether incurred at trial, in anticipation of trial or on appeal. You agree that no action, regardless of form, arising out of transactions relating to these Terms, may be brought by either party more than one (1) year after the cause of action has accrued.

You will be liable for all expenses, including attorneys’ fees, relating to the collection of past due amounts. All amounts past due shall bear interest at the rate equal to the lesser of (i) 1.5% per month, or (ii) the maximum rate allowed by applicable law.

These Terms constitute the entire agreement between you and Monster with respect to the subject matter contained herein and supersedes all other understandings or agreements, both written and oral, with respect to the subject matter. 

If any term or provision of these Terms is held to be invalid or unenforceable, such provisions shall be construed as severable and shall not in any way render invalid or unenforceable the remainder of the provisions that shall remain in full force and effect and, in lieu of the invalid or unenforceable provisions, there will be added as part of these Terms one or more provisions as similar in terms as may be valid and enforceable under applicable law.

Monster Transmission’s waiver of a breach of any of these Terms by you, which may only be effected in writing, shall not be deemed a waiver of any other breach by you of these Terms. The provisions of these Terms are for your and Monster Transmission's benefit and not for the benefit of any third party.

You shall not be entitled to assign any rights nor delegate any obligations under these Terms in whole or in part, by operation of law or otherwise, without Monster Transmission’s advance written consent. Any attempt by you to assign or delegate in violation of this provision will be void ab initio.
